* The Customer has no right to refuse the Goods that have individually definite properties, if the said Goods can be used exclusively by the Customer purchasing them.
* If the Customer rejects the Goods of proper quality, the Seller must return the amount of money paid by the consumer under the contract, except for the seller's expenses for delivery of the returned goods from the consumer, not later than 10 days from the date of the consumer's submission of a relevant demand.
Return of goods of improper quality
The goods of inadequate quality are understood to be those which are unable to provide their functional qualities due to a significant defect (with defects/blemish).
The buyer, to whom goods of inadequate quality were sold, if this was not agreed by the seller, has the right to assert any of the following claims at his discretion:
* replacement with goods of similar brand (model, article) or the same goods of another brand (model, article) with a corresponding recalculation of the purchase price;
* proportionate reduction of the purchase price;
* The buyer has the right to refuse to fulfill the contract, and the buyer has the right to refuse to fulfill the contract;
* The buyer has the right to refuse to fulfill the contract and demand a refund of the amount paid for the goods.
When returning technically complex goods of inadequate quality (the list of such goods is approved by RF Government Decree of 10.11.2011 № 924 "On approval of the list of technically complex goods") the Buyer has the right to demand
* replacement for a product of similar brand (model, article) or for the same product of another brand (model, article) with a corresponding recalculation of the purchase price;
* to withdraw from the contract and demand a refund of the amount paid for the goods.
All of the above claims for the return of goods of improper quality can be made in the following terms:
* The goods have a warranty period - throughout the warranty period;
* For goods without warranty period - within a reasonable period, but not more than 2 years.
The online store has the right to refuse to exchange or return the goods if it considers that the detected material defect is the result of improper use of the product.
In case of disagreement on the quality or causes of defects, the online store has the right to conduct an independent examination at its own expense. The buyer can participate in the examination and challenge its decision in court. If as a result of the examination it is found that the defects of the goods are due to the Buyer's fault, the Buyer shall reimburse the cost of the examination, as well as the costs of transportation and storage of goods associated with it to the online store.
The detected significant defect is the result of improper use of the goods.
In case of disagreement on the quality or causes of defects, the online store has the right to conduct an independent examination at its own expense. The Buyer may participate in the examination and challenge its decision in court. If as a result of the examination it is found that the defects of the goods were caused by the Buyer, the Buyer shall reimburse the cost of the examination, as well as the costs of transportation and storage of goods associated with the examination.
